CJ Rana recuses himself from hearing on writ against Constitutional Council ordinance

Kathmandu: Chief Justice Cholendra Shumsher Rana has recused himself from hearing on writ against Constitutional Council ordinance.

The Chief Justice took the decision after advocates argued that CJ Rana should recuse himself from the Constitutional Bench formed to hear the case as he is one of the defendants.

Legal practitioners had argued that CJ Rana should not hear the case as he had attended the meeting of the Constitutional Council in the capacity of its member and had also furnished a written clarification as a defendant.

Writ petitions were filed at the Supreme Court after the erstwhile KP Sharma Oli-led government had made recommendations to different constitutional bodies by amending the Constitutional Council Act.
