Kathmandu: A writ petition has been filed at the Supreme Court (SC) demanding a court’s order to scrap a provision that requires local level representatives to resign before filing nominations in the upcoming local-level elections.
Chairman of Helambu Rural Municipality Nima Gyaljen Sherpa moved the apex with the petition on Monday demanding to annul the code of conducts readied by the Election Commission arguing it to be illegal.
The court will hear the case on Tuesday.
Sherpa said that he filed the case as local-level will be rendered headless if the provision is implemented. He argued that the constitution has not envisioned local bodies sans elected representatives.
The code of conduct issued by the Election Commission mentions that local level representatives that are elected or nominated must resign before filing nomination for the upcoming local election slated for May 13.
