Writ filed at SC demanding proper utilization of pollution tax

Kathmandu: A writ petition has been filed at the Supreme Court (SC) demanding the court’s order to the government to deposit the pollution tax levied on petroleum products in a separate fund and spend it for pollution control.

Shreena Nepal and Abhyudya Bhetwal currently studying at Kathmandu School of Law moved the apex court with the petition.

In the petition in which the Office of the Prime Minister and the Council of Ministers has been named one of the defendants, petitioners have argued that the court should order the government to transfer the tax amount in the Federal Reserve Fund to a separate fund as the tax collected so far has not been used for the purpose it was collected.

The petitioners have demanded a mandamus order from the court to deposit the tax into a separate fund and use the amount for pollution control and prevention.

According to the Report of the Auditor General, Rs 9.43 billion pollution tax has been collected from the Fiscal Year 2008/09 to the Fiscal Year 2019/20.
