Supreme Court seeks written clarification from PM Oli over oath; declines to issue interim order

Kathmandu: The Supreme Court (SC) on Tuesday sought a written clarification within 15 days from defendants including Prime Minister K P Sharma Oli on writs filed against his oath.

A single bench of Chief Justice Cholendra Shumsher JBR issued the order. The bench, however, refused to issue an interim order as sought by the petitioners.

Advocates Dr Chandra Kanta Gyawali, Santosh Bhandari, Navaraj Adhikari and Raj Kumar Suwal among others had moved the apex court seeking clarification of the oath-taking process and nullifying the decision of appointing ministers who are not the member of Federal Parliament.

They had demanded the court issue an interim order directing the Prime Minister to take the oath of office and secrecy again as he had refused to pronounce few words.

The writ petition also alleged that Prime Minister Oli’s refusal to pronounce the word ‘vow’ while he was taking the oath before the President was an insult to the institution.

Stating that there are no prevailing laws governing the oath-taking, the petitioners had demanded to make public the details of the laws under which the oath was taken.

The Office of the President, Office of the Prime Minister and Home Minister Ram Bahadur Thapa, Energy Minister Top Bahadur Raymajhi, Industry Minister Lekhraj Bhatta, Urban Development Minister Prabhu Sah, Drinking Water Minister Mani Thapa, Labor and Social Security Minister Gaurishankar Chaudhary, Youth, and Sports Minister Dawa Lama are named as the defendants in the writ petition.
