Writ filed at Supreme Court against decision to scrap Land-related Problems Resolution Commission

Kathmandu: A writ petition has been filed at the Supreme Court on Friday against the government’s decision to scrap the Land-related Problems Resolution Commission.

Advocate Pravesh KC filed a writ petition arguing that the scrapping of the commission was unconstitutional. The petition has demanded that the government’s decision be overturned arguing that the fundamental right to housing has been violated. The Office of the Prime Minister and Council of Ministers, Prime Minister Sher Bahadur Deuba and the Ministry of Land Management, Cooperatives and Poverty Alleviation have been named defendants in the petition.

Article 37 of the Constitution mentions that every citizen shall have the right to appropriate housing and no citizen shall be evicted from the residence owned by him or her nor shall his or her residence be infringed except in accordance with the law.

The government on Tuesday had decided to scrap the Commission.

The Commission was formed as per the Land related Act (eighth amendment) to implement the state’s directive principles and policies, mentioned the statement. The Commission was formed around one year ago and a district-based committee of the Commission was formed in all the 77 districts.

The main opposition CPN-UML has been demanding an immediate correction to the government’s decision, saying the decision has hit the people’s expectations and rights. Protests have been staged in different parts of the country against the decision.
